Traditional or alternative dispute resolution service

Business dispute arises basically out of doubtful commercial transactions, claim for compensation, demand of damages etc. Traditional mode of litigation involves prior client counselling, litigation pre-planning, budgeting, exploring alternative options and fora, initiation of proceedings, defending the client, compounding if commercially prudent, compromise on going forward, executing/ enforcing court order/decree and overall case brief management in diverse fora by briefing, interacting, coordinating and communicating with the external counsels and others by identifying respective roles and responsibilities.

If written contract between the parties provides so, or even otherwise by consent, a commercial dispute may be referred to alternative mode of dispute resolution by arbitration, conciliation, mediation, negotiation, arrangement and compromise in private or through ad hoc/institutional arbitration. Unlike adversarial litigation, ADR proceedings are often collaborative, allow the parties to understand each other's position and allow them to come up with innovative but commercially prudent solutions and alternatives that law courts may not be legally allowed to offer within the given legal framework or under reliable judicial precedents.
